Verification of Valid and Current Legal Malpractice Insurance

Our clients who post hearings and/or opportunities in which they require our network attorneys to appear and perform some function have an option to require that all appearing network attorneys have current and valid legal malpractice insurance. Being covered by insurance is not a requirement for an attorney to join the Docketly network. This compliance requirement is client based and dependent on the compliance standards our posting law firms choose to elect. 

Many of our network attorneys carry some sort of E&O insurance policy with minimum coverage of $100,000 per occurrence and $100,000 aggregate. 

When a network attorney first joins Docketly, they are given several compliance tasks that they are asked and/or required to complete. One of them is uploading a copy of their current malpractice declaration page. After uploading to their compliance account, an Docketly staff member reviews the submission, and marks the date that the insurance policy expires. 

Once validated the attorney is free to select and cover any hearings posted in his jurisdiction for which insurance is mandated. After the attorney selects the hearing using our system, our posting clients/firms have the ability to review the attorneys contact, biographical, and good standing information - as well as downloading a copy of the attorney's current E&O insurance declaration page.

Using the example above, this attorney's insurance will expire on 20 April 2015. On 19 April 2016, the attorney will receive an automated notification from our system requesting that they upload an updated policy declaration page to their compliance center.  Until they do so, they will not be able to select hearings for which insurance is required. 

Important: As of April 1, 2018, Docketly secured a legal malpractice/professional liability policy that covers all Docketly Network Attorneys and insures most hearings posted through Docketly. The limits of this policy are $100k per occurrence with a $1m aggregate. The only exception to coverage are for those hearings posted to Docketly by a Docketly customer and covered by the customer's employed or "in-house" attorney using our calendar management tools. However, and for the time being, Docketly will continue to accept, verify, and process its network attorneys' private insurance policies.
